Application by father for summary return of child to Pakistan, pursuant to the Court’s Inherent Jurisdiction. Return ordered. Full report: National Archives.
H (A child) (HABITUAL RESIDENCE) [2022] EWFC 104 (29 July 2022)
Application by father for summary return of child to Spain, in which a primary issue was whether, at the time of his removal, the child was habitually resident in Spain. Held that he was. Mother's Art 13(b) defence failed & return ordered. Full report: Bailii.
